Bravo To The Attorneys At Microsoft
The lawyers at Microsoft continue to think outside the box as they utilize current cyber related laws on the books to take down phony sites. When I read the attached article, I was impressed by the creativity of the attorneys at Microsoft using the Computer Fraud and Abuse Act (CFAA) as well as the Electronic Communications Privacy Act (ECPA) to take down phony sites. Microsoft did not wait for the law to catch up with the crime, it understood that all crimes, even those solely perpetrated on the internet, are basically the same. Forget the technical aspects of a “spear phishing” campaign that redirects people to a false site. Get an injunction because the site uses the Microsoft logo, in violation of copyright laws. Microsoft attorneys used this same strategy when shutting down botnets in 2013.
So often we are so caught up in the way hackers are attacking us, we don’t give thought to the underlying crime and the law provides relief for those that are victims. I am sure there are plenty of large in-house legal departments that have utilized these laws to shut down malicious sites. Hopefully this will filter down to SMB’s that suffer from the same types of crimes.
